1. Definitions
Hot Recruitment means this or any other related website belonging to the Hot Recruitment Consultants Ltd or any subsidiary or related companies or products
Recruiter means any person, agency, company, organisation or firm who purchases services from Hot Recruitment Consultants Ltd or any subsidiary or related companies
Jobseeker means the person using the site for career related purposes
Services means all products made available by us
Order means an order for the supply of services provided by us and signed by the Recruiter
Agreement means an obligation to pay in advance for services stated on the order for the term specified
2. General
You agree that by using the website you agree to be bound by its terms.
Visitors submitting information to this site, warrant that such information is complete, true and accurate.
Hot Recruitment may use the information submitted to create a database for the purposes of assessing suitability, qualifications and skills for current work assignments and assignment that may be of interest in the future.
We may use visitor information to keep such visitor informed by email, telephone and post on work opportunities, industry updates and products/services that Hot Recruitment consider will be of interest.
By responding to the site you are deemed to consent to Hot Recruitment processing personal or business data about you or your company for the above purposes.
If you do not want to receive information then telephone or email us.
3. Disclaimer
· Hot Recruitment makes no warranties or representations on its site(s) regarding contents, accuracy, completeness or suitability and is excluded from liability for same.
· Hot Recruitment, its representatives, owners and employees are not liable for any loss or damages of any kind arising in connection with using this site whether directly or indirectly and are not liable for any loss of data, income, profit, loss of or damage to property and claims of third parties.
· All services are provided in good faith and we cannot guarantee the validity of any representations made by the Jobseeker on their CV or on their availability or qualification to perform duties to the Recruiter nor shall we be responsible to the Jobseeker for the accuracy or availability of any information provided by the Recruiter.
· If Jobseekers do not wish their details to be provided directly to the client then the Jobseeker should not register or upload your CV on the site and contact us directly on 01923 431789 or email and requesting that your CV be treated as strictly confidential.
4. Services
· We will commence providing services when we have received and approved the signed agreement and/or order and Hot Recruitment will allow access to our site to Jobseekers and Recruiters subject to these Terms & Conditions.
· By registering your details on the site you are expressly giving permission for your application and CV details to be forwarded directly to the Recruiter under our Online Recruitment facility.
· We do not guarantee Jobseekers will get a response to their application
· We do not guarantee that Recruiters will receive a response to their job
5. Variations
Hot Recruitment reserves the right at any time and without notice to revise the site content and these terms and conditions. Any changes will be visible on our site and by continuing to use the site, the Jobseeker and Recruiter are agreeing to be bound by the revised terms and conditions.
6. Using information
Jobseekers and Recruiters acknowledge and agree to be bound to the terms of our Privacy Policy
7. Prices
· The website is free of charge to Jobseekers.
· Recruiter prices are guaranteed for the period stated on the order.
· Recruiter packages are purchased in advance will be live on the site for one month.
· All prices are exclusive of Value Added Tax at the prevailing rate
8. Termination
· The Recruiter can terminate the provision of services with no less than 30 days notice and termination by the Recruiter before the end of the Contract term will render the Recruiter liable for paying the remainder of the contract unless specifically otherwise agreed in writing.
· We can terminate the provision of services if the Recruiter breaches these Terms and does not remedy the breach within 10 working days or if the Recruiter becomes insolvent, goes into liquidation or ceases to trade.
9. Employment Agencies and Employment Business Regulations
· We operate the Online Recruitment Product as a venue only
· If you are a jobseeker it is your responsibility to check out the Recruiter and the conditions of work.
· If you are a Recruiter, it is your responsibility to check that the jobseeker has the appropriate skills, experience, ID and right to work.
10. Site rules
We have the right to remove any Recruiter advert that is in breach of our rules which include
· Copying other clients jobs
· Vacancies must be genuine and not posted for the purpose of selling other products including but not limited to pyramid selling, affiliate schemes or other business opportunities
· If we think adverts are discriminatory we can, at our discretion, amend or delete the posting and we will inform you should this be the case.
· We will remove any Recruiter advert if the content brings us into disrepute or which Is defamatory or illegal and the Recruiter will indemnify us against any claims or liability arising from Recruiter content or links
· Recruiters will take full responsibility for the content of the adverts they post with us and if they breach any rules or are illegal adverts because they discriminate on race, age, sex or disability or any other legislation or law, then the Recruiter understands that they will be responsible for any proceedings issued
· Recruiters undertake to deal with jobseekers in a professional way and will indemnify us from and against any claim brought by an individual or company arising from your breach of this obligation and these terms and conditions
· We don’t guarantee you will get a response to your adverts or that the responses you do get will be suitable for the job you have advertised
· It is up to the Recruiter to make sure they are connected to the appropriate services in order to post jobs on our site
· Any job postings appearing on our site may also appear on third party or related sites
· Recruiters and Jobseekers will keep information confidential
11. Technical stuff
· We cannot be held liable for any technical faults that are outside of our control.
· You may be offered links to other websites on our site and we are not responsible for the practices or contents of such links and we do not accept any liability for this and you access these sites at your own risk. You can only link to our website with our prior written consent which we can withdraw at any time
13. Database & Site contents
· We operate a fair usage policy and if we deem that a Recruiter is using the job posting facility/database in an inappropriate or unfair way, we will limit the access to a specified daily number or withdraw the facility and there will be no rebate eligible in these circumstances
· The Recruiter will not obtain any unauthorised access to our networks or information and will not corrupt any data or cause or send a virus of any sort to damage, crash, delay or interfere with the function on our site(s)
· The Recruiter will not spam or flood our site or its infrastructure
· Copyright and intellectual property rights and candidate database rights belong to us and the Recruiter agrees that the Recruiter does not have any rights in the database or its contents or the site contents
· Once the CV database use is purchased by the Recruiter, the Recruiter can use the information to search and find suitable candidates to fill their posts or if on behalf of their clients, their clients’ posts
· The Recruiter can only use the information on our site and the jobseeker CV database for the purposes of recruitment related activities.
· The Recruiter cannot supply, copy, sell or licence material on our site or CV database to any other person including another other group of companies.
· The Recruiter cannot download or scrape the database or site content through any automated process
· The Recruiter cannot use our site or database for any other purpose than to fill job vacancies
· The Recruiter will comply with the Data Protection Act and relevant legislation and regulations
· The Recruiter agrees to professionally and sensitively handle the information on the site and CV database and will not do anything to bring us into disrepute or breach these terms and the Recruiter will keep us indemnified against any claim arising from said breach
14. Passwords
The password is for the sole use of the person to whom it is issued
15. Liability
By placing adverts through our Online Recruitment Product, the Recruiter accepts these terms and conditions and will indemnify us against all or any claim resulting in a breach of these terms, law or legislation. Additionally, we shall not be liable for failure to display postings due to circumstances outside our control.
These terms shall be governed by and construed in accordance with the laws of England and Wales and be subject to the exclusive jurisdiction of the Court of England and Wales. The application of law of each European Community member state is excluded from having operation regarding these terms.
